A jak prodat pozemek za maxim\u00e1ln\u00ed cenu? O tom se do\u010dtete v\u00a0tomto pokra\u010dov\u00e1n\u00ed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-white-color has-vivid-cyan-blue-background-color has-text-color has-background has-link-color has-medium-font-size wp-elements-b0879fc4d08c4dbb9659b04eaec6bb2a\"><strong>Da\u0148ov\u00e9 povinnosti<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\">Dobrou zpr\u00e1vou je <strong>zru\u0161en\u00ed dan\u011b z nabyt\u00ed nemovitosti. <\/strong>Da\u0148 \u010dinila 4 % z kupn\u00ed ceny a hradil ji kupuj\u00edc\u00ed. Od roku 2020 u\u017e se v\u0161ak touto dan\u00ed zab\u00fdvat nemus\u00edte, konkr\u00e9tn\u011b <strong>31. b\u0159ezna 2020 do\u0161lo k&nbsp;jej\u00edmu \u00fapln\u00e9mu zru\u0161en\u00ed.<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>V roce 2021 ale prob\u011bhly v podm\u00ednk\u00e1ch osvobozen\u00ed od dan\u011b z p\u0159\u00edjmu zm\u011bny.<\/strong> Zejm\u00e9na jde o to, \u017ee tzv. \u010dasov\u00fd test se prodlou\u017eil z p\u011bti na 10 let. Nicm\u00e9n\u011b to plat\u00ed jen pro nemovitosti nabyt\u00e9 po 1. lednu 2021. Z hlediska dan\u00ed tedy vznikly dv\u011b kategorie nemovitost\u00ed:<\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\"><strong>\u2013 nabyt\u00e9 p\u0159ed 1. 1. 2021:<\/strong> osvobozeny od dan\u011b z p\u0159\u00edjmu ji\u017e po p\u011bti letech od koup\u011b<\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\"><strong>\u2013 nabyt\u00e9 po tomto datu:<\/strong> osvobozeny od dan\u011b a\u017e po 10 a v\u00edce letech.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Platnou dan\u00ed t\u00fdkaj\u00edc\u00ed se prod\u00e1vaj\u00edc\u00edho je<strong> da\u0148 z prodeje pozemku<\/strong> (da\u0148 z p\u0159\u00edjm\u016f). V\u00fd\u0161e t\u00e9to dan\u011b je<strong> 15 % <\/strong>a vypo\u010d\u00edt\u00e1v\u00e1 se ze zisku (nikoliv z prodejn\u00ed ceny!). Zisk je v tomto p\u0159\u00edpad\u011b rozd\u00edl mezi po\u0159izovac\u00ed a prodejn\u00ed cenou. Da\u0148 se zahrne do standartn\u00edho da\u0148ov\u00e9ho p\u0159izn\u00e1n\u00ed dan\u011b z p\u0159\u00edjmu. N\u011bkte\u0159\u00ed z prod\u00e1vaj\u00edc\u00edch v\u0161ak jsou od platby t\u00e9to dan\u011b osvobozeni. <strong>V\u00fdjimkami jsou:<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\"><strong>\u2013 Prod\u00e1vaj\u00edc\u00ed byl vlastn\u00edkem minim\u00e1ln\u011b 5\/10 let<\/strong> (pokud prod\u00e1vaj\u00edc\u00ed zd\u011bdil pozemek v p\u0159\u00edm\u00e9 linii, nen\u00ed nutn\u00e9 \u010dekat na uplynut\u00ed p\u011btilet\u00e9 lh\u016fty)<\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\"><strong>\u2013 Prod\u00e1vaj\u00edc\u00ed vyu\u017eije utr\u017een\u00e9 pen\u00edze na uspokojen\u00ed vlastn\u00ed bytov\u00e9 pot\u0159eby<\/strong>, a to nejpozd\u011bji do jednoho roku. Uspokojen\u00edm pot\u0159eby se rozum\u00ed nejen koup\u011b bytu, domu nebo pozemku, ale tak\u00e9 rekonstrukce.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Je-li subjekt pl\u00e1tcem DPH a p\u0159edm\u011btem prodeje je stavebn\u00ed parcela, je t\u0159eba po\u010d\u00edtat s \u00fahradou dan\u011b z p\u0159idan\u00e9 hodnoty ve v\u00fd\u0161i 21 % ceny nemovitosti. <\/strong>Od roku 2016 se toti\u017e do z\u00e1kona o DPH op\u011btovn\u011b vr\u00e1tila i definice pozemku.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">DPH z prodeje pozemku se neplat\u00ed v n\u00e1sleduj\u00edc\u00edch p\u0159\u00edpadech:<\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\"><strong>\u2013 Prod\u00e1vaj\u00edc\u00ed nen\u00ed pl\u00e1tcem DPH.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center has-medium-font-size\"><strong>\u2013 P\u0159edm\u011btem prodeje nen\u00ed pozemek ur\u010den\u00fd k v\u00fdstavb\u011b (stavebn\u00ed pozemek).<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/www.ipr-real.cz\/wp-content\/uploads\/2024\/01\/pozemkova-dan-WP-1024x768.png\" alt=\"\" class=\"wp-image-3812\" style=\"aspect-ratio:16\/9;object-fit:cover\" srcset=\"https:\/\/www.ipr-real.cz\/wp-content\/uploads\/2024\/01\/pozemkova-dan-WP-1024x768.png 1024w, https:\/\/www.ipr-real.cz\/wp-content\/uploads\/2024\/01\/pozemkova-dan-WP-300x225.png 300w, https:\/\/www.ipr-real.cz\/wp-content\/uploads\/2024\/01\/pozemkova-dan-WP-768x576.png 768w\" sizes=\"auto, (max-width:767px) 480px, (max-width:1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading has-white-color has-vivid-cyan-blue-background-color has-text-color has-background has-link-color has-medium-font-size wp-elements-35f8421f70f4f6042fa8c2b52eac164e\"><strong><strong>P\u0159edkupn\u00ed pr\u00e1vo<\/strong><\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\">P\u0159ed samotn\u00fdm prodejem by si m\u011bl vlastn\u00edk pozemku je\u0161t\u011b ov\u011b\u0159it, zda v jeho p\u0159\u00edpad\u011b neplat\u00ed tzv. p\u0159edkupn\u00ed pr\u00e1vo. Nenechte se zm\u00e1st, <strong>p\u0159edkupn\u00ed pr\u00e1vo bylo sice k 1. \u010dervenci 2020 zru\u0161eno, nicm\u00e9n\u011b pozemky jsou jednou z v\u00fdjimek.<\/strong> Tou je p\u0159\u00edpad, kdy <strong>na pozemku stoj\u00ed ciz\u00ed stavba<\/strong>, tedy v p\u0159\u00edpad\u011b \u017ee pozemek a stavba maj\u00ed jin\u00e9 majitele.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">V sou\u010dasn\u00e9 dob\u011b je\u0161t\u011b st\u00e1le takov\u00e9 p\u0159\u00edpady najdeme \u2013 vzhledem k&nbsp;tomu, \u017ee do roku 2014 bylo mo\u017en\u00e9, aby pozemek a <strong>stavba na dan\u00e9m pozemku m\u011bly jin\u00e9 vlastn\u00edky<\/strong>. P\u0159edkupn\u00ed pr\u00e1vo ud\u00e1v\u00e1, \u017ee pokud se ve v\u00fd\u0161e uveden\u00e9m p\u0159\u00edpad\u011b jeden z vlastn\u00edk\u016f rozhodne pro prodej, je jeho povinnost\u00ed prvn\u011b nab\u00eddnout ke koupi vlastn\u00edkovi druh\u00e9ho objektu. <strong>C\u00edlem je, aby p\u0159edkupn\u00ed pr\u00e1vo napomohlo k ucelen\u00ed pozemk\u016f s objekty.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading has-white-color has-vivid-cyan-blue-background-color has-text-color has-background has-link-color has-medium-font-size wp-elements-775f1d24f388890f1c5bbbfb6a6e0de3\"><strong>Pr\u00e1vo stavby<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\">V sou\u010dasn\u00e9 dob\u011b by stavba m\u011bla b\u00fdt sou\u010d\u00e1st\u00ed pozemku. <strong>Existuj\u00ed v\u0161ak v\u00fdjimky, nap\u0159. pr\u00e1vo stavby, kter\u00e9 umo\u017e\u0148uje postavit stavbu na ciz\u00edm pozemku<\/strong>. Pr\u00e1vo stavby je p\u0159edm\u011btem vlastnick\u00e9ho pr\u00e1va a najdete ho <strong>zapsan\u00e9 v katastru nemovitost\u00ed<\/strong>. Toto pr\u00e1vo lze z\u00edskat na z\u00e1klad\u011b smlouvy nebo rozhodnut\u00ed org\u00e1nu ve\u0159ejn\u00e9 moci.
